1. JULI: 30 Huurders NIET op Straat

EN: The Feb 17 verdict in favour of the Groene Groep included our July 1 eviction EXCEPT if we take the case to appeals court - which we have done. August 17, 2006 is the official date for the submission of our grounds for appeal in Den Haag. In the meantime, we will relentlessly continue to develop our own plan for the renovation of the Poortgebouw building upon the 25 year living function and offering space for diverse cultural functions. NL: De uitslag van het kort geding in het voordeel van de Groene Groep betekende dat we op 1 juli ontruimd zouden worden. Het vonnis is echter niet per direct uitvoerbaar wat betekend dat als we verder procederen, we er niet uitgezet kunnen worden tot het vonnis van het Hoger Rechtshof anders bepaald. Op 17 augustus is de officiele datum dat wij onze memoire van grieven in moeten dienen in Den Haag. In de tussentijd zullen we gestaagd doorwerken aan de ontwikkeling van onze eigen plannen voor de renovatie van het Poortgebouw bouwend op de ervaring van 25 jaar woongroep en culturele activiteiten.

Vrijdag 17 februari heeft de rechter uitspraak gedaan in de procedure die projectontwikkelaar “De Groene Groep” had aangespannen tegen onze vereniging. De inzet was de beëindiging van ons huurcontract i.v.m "dringend eigen gebruik" En wel voor dringende renovatie tot luxe kantoren. Het vonnis is voor ons negatief uitgevallen, de rechter heeft besloten dat het huurcontract per 1 juli 2006 afloopt en dat dertig bewoners, met kinderen, op straat staan. Zonder vervangende woonruimte of vergoeding. Wel heeft de rechter ons de mogelijkheid gegeven in hoger beroep te gaan bij het Hoger Gerechtshof in Den Haag. Dit houd in dat de strijd nog niet gestreden is. Vereniging ‘t Poortgebouw vecht door en gaat in hoger beroep. MORE

2nd Message from the Rechtbank

NL: Van de kantonrechter hebben wij opnieuw het bericht ontvangen dat het vonnis niet doorgaat. Op 23 december 2005 hoopt de kantonrechter in deze zaak een vonnis te wijzen. Dit zegt niets over ons kansen of die van de Groene Groep. Dit heeft vooral te maken met de omvang van de zaak en de tijd die de kantonrechter beschikbaar heeft om zich in de zaak de verdiepen.

Message from the Rechtbank

NL: Van de rechtbank hebben wij het bericht ontvangen dat de rechter niet toegekomen is aan het maken van een (tussen)vonnis. De rechter zal nu over vier weken een vonnis maken en verzenden. Dat zal in de week van 28 november zijn...
EN: We received a message from the court that the judge has not yet managed to come to a verdict/finding. The judge has extended this date for four weeks which means we should hear something in the week of November 28.

Wethouder Pastors letter to the WBR

It took two months for Councillor Marco Pastors to finally get around to writing the promised letter to the WBR (our former owner who sold our house behind our backs in 2001). The letter is the result of our April 5th and 12th “Tochten” (marches) to the Commission Meetings for Physical Infrastructure. Even though the majority of the commission supported our inquiries into the legitimacy of the sale to the Groene Groep and our demand for the standpoint of the Gemeente on the issue, the lack of vision/position expressed in Pastors’ letter is no big surprise. ENGLISH SUMMARY: On Tuesday, April 5 at 9:00, members of the Vereniging Poortgebouw with friends and supporters marched from the PG to the Stadhuis to attend an open meeting of the “commissie Fysieke Infrastructuur en Verkeer”. We delivered the over 2000 online and analogue petition signatures and demanded an official statement of the Gemeente Rotterdam’s position and role in the sale of the Poortgebouw and the legal case with de Groene Groep. The Poortgebouw case was discussed for 30 minutes by the commission and we are invited back next Tuesday for some answers from Wethouder Pastors.

In de zaak tegen De Groene Groep Monumenten BV heeft de kantonrechter bepaald dat het vonnis heden niet doorgaat. De kantonrechter heeft 6 weken extra nodig om te bepalen wat er verder moet gebeuren. Op de rolzitting van 13 mei 2005 zal de kantonrechter opnieuw een poging doen om tot een tussenvonnis te komen.

Voor de 30 bewoners van woongroep Het Poortgebouw is het lang gevreesde moment aangebroken. Het monumentale Poortgebouw is door het Woning Bedrijf Rotterdam (WBR) voor de prijs van een eengezinswoning (± 350.000 euro) verkocht aan projectontwikkelaar De Groene Groep (DGG). De nieuwe eigenaar wil het pand herbestemmen tot kantoor en heeft hiertoe de huidige bewoners per 1 februari 2005 de huur opgezegd. De vraag rijst of er voor de woongroep, na 20 jaar netjes huur betalen, geen andere optie overblijft dan het pand te moeten verlaten.

It was a debate addressing the importance of free spaces for experiment within the Rotterdam cultural climate.
